Other information | On 1924 application: 'I d esire a British naturalization to enable me to enjoy the rights of a British citizen in England. In the latter country I am considered an Alien and have therefore no fixed nationality except in Australia' Handwritten in: 'on the Continent I have no nationality.' and 'My mother is married again to a British subject. The marriage took place about 18 years ago. She has therefore rgained her British nationality.' |
Hernia to Chief Clerk, External Affairs, 21 March 1917: wants to know how to apply. father French and mother English; 'brought up in France but born in Holland.' Certificate reference: Perry Howe providing reference as Hernya 'states she is not known by a Justice of the Peace or any of the officers required to give such certificate'
Hernya to Minister, H& T, 27 April 1923: tried registering at British Consulate in Geneva but 'informed that my naturalization was only a local one'. Asks for imperial naturalization certificate. She is a 'Member of the Secretariat of the League of Nations - consequently living in Geneva'. Includes a copy of letter advice from Furhman, secretary to the High Commissioner, Australia House, London, 16 April 1923
H&T Dept Memorandum, JWC, 15 June 1923: doesn't usually grant certificates to people living outside the country and thinks the advice from the High COmmissioner, which suggested they had power under 1920 Act to grant imperial natz 'not strictly correct'. 'Sec. 9 of the Cmth Nationality Act 1920 empowers the Gov. Gen. to issue Imperial Certf to persons naturalized prior to the announcement of the Act if he is "satisfied that" the applicant is of good character and would have been eligible had he remained an alien'. SHe would not be eligible currently (residency)
Someone has written underneath [FyN?], to Mr Carrodus [?], 15/6: 'Is there not a possiblity that she may be employed by the Crown?'
JWC, 15/6, reply: 'She may be... but if she is merely an official in a general capacity of the League of Nations I do not think she can be considered as being in the service of the Crown'
McLaren, Secretary, H&T, to Attorney-General's Dept., 28 june 1923: explains 'Applications for Certificates under the Nationality Act 1920-22 are frequently received by the Department from persons resident abroad who had been naturalized in Australia prior to the commencement of the Act. It has been the practice of the Department to refuse all such applications.' Asking for formal clarification whether correct
